A LEGAL DISCLAIMER

PLEASE READ THE FOLLOWING PARTICIPANT AGREEMENT IN ITS ENTIRETY.

Provision of Services:

By booking a trip with Cocosine, the Retreat Participant agrees to these Booking Terms and Conditions. This document DOES NOT constitute the entire agreement between the Retreat Participant and Cocosine, and your booking will be accepted on this basis.

PLEASE SEE THE PARTICIPANT AGREEMENT FOR ALL TERMS AND CONDITIONS.

a. Travel Insurance

Cocosine strongly encourages comprehensive travel insurance for all Retreat Participants. It is solely the responsibility of the Retreat Participant to secure such coverage, if she chooses to do so. If the Retreat Participant chooses to obtain travel insurance, Cocosine recommends that it cover trip cancellations, trip interruptions, medical emergencies abroad, emergency evacuation, loss of baggage and flight delays.

b. Passports and Visas

Each Retreat Participant is required to carry a valid passport and obtain all required visas and/or permits for countries visited. All passports must be valid for 6 months beyond the duration of your trip. Cocosine is not responsible for travel interruptions or cancellations due to the Retreat Participant’s failure to obtain or secure proper travel documentation prior to departure.

c. Participant Information 

In order to efficiently facilitate Cocosine Retreats, Cocosine requires specific details from each Retreat Participant upon booking and at least 6 weeks prior to departure. Each Retreat Participant must provide the following information:

(1) her full name as it appears in her passport

(2) her passport number and issue/expiration date

(3) her date of birth

(4) nationality as it appears in her passport

(5) any and all allergies (food or otherwise)

(6) dietary preferences

(7) flight itinerary

8) any and all pre-existing medical conditions regardless of severity or duration of such condition

The foregoing information must be submitted upon booking and no later than six (6) weeks prior to departure.

PARTICIPANT AGREEMENT

e. Physical Activity & Assumption of Risk

By agreeing to Cocosine Retreats Booking Terms and Conditions, the Retreat Participant recognizes that voluntarily participating in yoga, surfing, boating, swimming, hiking, and other forms of exercise and other activities, requires physical exertion and activity, and as is the case with any physical movement or activity, the risk of injury, sometimes serious, is always present and cannot be eliminated.

Additionally, the Retreat Participant recognizes that she may also be visiting places where the political, cultural, and geographical attributes of the location present risks and physical challenges that are greater than those present in her country of residence. It is the Retreat Participant’s own responsibility to familiarize herself with all possible relevant travel information in connection with her participation in the Retreat.

Understanding and in full consideration of the foregoing, the Retreat Participant agrees to solely and

exclusively assume full and complete responsibility for, and the risks inherent in, Travel and engaging in Physical Activity which may include injury, death, property damage, and/or any other kind of Liability, whether foreseen or unforeseen, which may occur during her participation in the Retreat. Further, by participation in activities and travel, the Retreat Participant agrees to release, indemnify, and hold harmless Cocosine and all Team Members, Agents, Instructors, Trainers, Volunteers, Guides, and other Representatives from any and all liability and responsibility arising out of, resulting from, related to, and/or caused in whole or in part, by bodily injury, illness, or death.

f. Choice of Law and Jurisdiction

Retreat Participant irrevocably agrees that this Agreement shall be governed by the laws of the State of New York, that any mediation, suit, or other proceeding must be filed or entered solely and exclusively in Manhattan, New York and that the federal or state courts located in Manhattan, New York and any courts of appeal therefrom shall have sole and exclusive jurisdiction to settle any dispute arising under or in connection with this Agreement (including any disputes as to this Agreement’s existence or validity). You waive any objection (on the grounds of lack of jurisdiction, forum non conveniens, or otherwise) to the exercise of jurisdiction by such courts.

g. Health Eligibility

By agreeing to Cocosine Retreats Booking Terms and Conditions, the Retreat Participant represents that she is over the age of eighteen (18), is healthy, in good physical and mental health, and is at a level appropriate to participate in, and is fully capable of participating in, the Retreat. The Retreat Participant further represents that she does not suffer from any medical conditions or disabilities that may restrict, limit, prevent, or preclude her participation in the Retreat, including any Physical Activities. She has consulted with a physician and her physician has authorized her to participate in the Retreat, including any Physical Activities. If, at any time, she has any doubts about her physical condition or fitness to participate in any aspect of the Retreat, she will cease participation in the same and seek appropriate medical attention.

YOU ARE HEREBY ADVISED THAT THE RETREAT MAY TAKE PLACE IN REMOTE AREAS WHERE

THERE IS LITTLE OR NO ACCESS TO TRADITIONAL MEDICAL SERVICES OR HOSPITAL FACILITIES FOR SERIOUS HEALTH

ISSUES (OR YOUR PARTICULAR HEALTH ISSUES). YOU ARE FURTHER ADVISED THAT ANY MEDICAL OR EVACUATION

EXPENSES WILL BE YOUR SOLE RESPONSIBILITY. As a result, we strongly encourage Retreat Participants to purchase travel Insurance with appropriate coverage for her needs. We reserve the right in our sole discretion to refuse participation in the Retreat, any Retreat Classes, Physical Activities, and/or any other activities, due to medical, fitness, or other grounds. Cocosine also reserves the right tto deny participation in the Retreat or any related activities at any time to individuals demonstrating behavior that may result in injury to themselves or others.

h. Code of Conduct

Each of the Cocosine Retreat destinations have cultural customs unique to each region including attire, food, drink and other social aspects. Though Cocosine will provide cultural information on each location, it is recommended that Retreat Participants research on her own as well. Cocosine reserves the right to remove a Retreat Participant from a trip if she is found to be engaging in and/or using any illegal activity or drug and/or hazardous behavior. Such removal shall be at the Research Participant’s own financial expense.
